Expert Witness – Land Use, Real Estate, and Zoning Law

Matter of the City of New York Relative to 22 Second Avenue; Matter of the City of New York Relative to 38 Second Avenue: currently retained by eminent domain counsel for separate claimants to prepare expert reports and testify at trial as to highest and best use of commercial real estate. 

  Matter of the City of New York Relative to 226 Nevins Street; Matter of the City of New York Relative to 242 Nevins Street, 242 Nevins Inc.; and Matter of the City of New York Relative to 270 Nevins Street:currentlyretained by eminent domain counsel for separate claimants to prepare expert reports and testify at trial as to highest and best use of commercial real estate.  

  Matter of the City of New York Relative to New Creek Bluebelt, Phase 4, Ivan Galarza, Claimant and The City of New York, Condemnor, 58 Misc.3d 1210(A), 2018 WL 413750 (Sup. Ct. Richmond Co. 2018): prepared an expert report and testified at trial that the highest and best use of condemned property would be to litigate a regulatory takings claim. The Court agreed and valued the condemned property accordingly, significantly increasing the just compensation award.

  Herrick Feinstein:retained as a land use law expert by defense counsel in a malpractice lawsuit to prepare an export report and testify at trial as to standards of practice of land use and commercial real estate attorneys. The case was settled.

  Maplewood, Inc. v. Wood (Supreme Court, Nassau Co.): qualified as an expert in land use law, real estate, and zoning law; testified at a jury trial for prevailing party.
